CureWise.com ("CureWise," "we," "us," or "our") is committed to protecting your privacy and handling your information in an open and transparent manner. This Privacy Policy ("Policy") describes how we collect, use, disclose, transfer, store, and protect your personal information when you access or use our website, mobile applications, and related services in connection with that certain TOS (Terms of Service, our terms of service for the CureWise website or "TOS") that is integrated and incorporated herein (collectively "Service"). This Policy is designed to comply with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), and other applicable privacy laws worldwide. Reference to the Policy includes automatic reference to the underlying TOS, the terms of which are incorporated into this Policy.

By using the Service, you acknowledge you have read, understood, and agreed to this Policy. If you do not agree with this Policy (including the incorporated TOS), please do not use the Service.

Scope

This Policy applies to all users of the Service, including registered and unregistered users, authorized representatives, or other visitors, regardless of location. It covers all personal information collected, processed, or stored by CureWise in connection with the Service.

Information You Provide to Us

  • Account Registration: Name, email address, password, date of birth, and other information required to create and verify your account.

  • Profile Information: Information you choose to add to your profile, such as biographical information, health-related preferences, and contact details.

  • Content Submission: Any content you upload, post, or contribute, including health records, medical documents, lab results, genomic and genetic data, images, messages, and other health-related information you choose to provide.

  • Payment and Billing Information: Payment method, billing address, and transaction details (processed via third-party payment providers).

  • Communications: Information you provide when you contact us for support, submit feedback, participate in surveys, or otherwise communicate with us.

Information We Collect Automatically

  • Usage Data: IP address, device type, operating system, browser type, referring URLs, access times, pages viewed, links clicked, and other usage information.

  • To Provide AI-Powered Educational Analysis: To analyze health information you provide and generate educational summaries, organizational tools, and AI-powered outputs to help you prepare for healthcare conversations and better understand your health information.

  • To Process Payments: Including subscription fees and billing for use of the Service.

  • To Communicate with You: About your account, transactions, updates, security alerts, and administrative messages.

  • To Provide Support: Responding to your inquiries, troubleshooting, and resolving disputes.

  • To Personalize Your Experience: Customizing content, recommendations, and features based on your preferences and activity.

Legal Bases for Processing (GDPR)

  • Performance of a Contract: To provide and operate the Service, manage accounts, and process transactions.

  • Legitimate Interests: To secure and improve the Service, prevent fraud, enforce policies, and protect users and our business, provided such interests are not overridden by your fundamental rights.

  • Consent: For marketing communications, cookies, analytics technologies, and other processing where required by law. You may withdraw consent at any time. Withdrawal does not affect processing already performed.

  • For Legal Reasons: To comply with legal obligations, respond to lawful requests, protect our rights, property, or safety, or prevent fraud or abuse.

  • In Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of the transaction.

  • With Your Consent: We may share your information for other purposes with your explicit consent.

We do not sell your personal information to third parties. If you are subject to GDPR, you have the right to object to certain data sharing and processing practices, including sharing based on legitimate interests. Upon receiving a valid objection request, CureWise will cease the disputed processing unless legally permitted to continue under applicable laws. CureWise does not use sensitive health information for third-party advertising.

International Data Transfers

CureWise is based in the United States. If you access the Service from outside the U.S., your information may be transferred to, stored, and processed in the U.S. and other countries. We implement appropriate safeguards, such as Standard Contractual Clauses under the GDPR, to protect your data as required by law. We also assess international transfers on a case-by-case basis and implement supplementary safeguards where required to ensure an essentially equivalent level of protection.

Data Retention

We retain your personal information for as long as necessary to provide the Service, fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. The retention period may vary depending on the type of data and applicable legal requirements. You may request deletion of your account and data, subject to certain limitations. We may retain certain data as necessary to defend against legal claims, even after account deletion.

CureWise will honor such requests unless retention or continued processing is required by law or justified by compelling legitimate grounds.

  • Non-Discrimination: You will not be discriminated against for exercising your rights.

Security

You are responsible for maintaining the confidentiality of your login credentials. Because CureWise handles sensitive health information, we apply safeguards consistent with health-industry security standards, including encryption of health data in transit and at rest, role-based access controls, and audit logging of access to health records. CureWise is not a HIPAA covered entity; however, we apply privacy and security standards to all health information that are at least as protective as those required under HIPAA.

Children's Privacy

The Service is not intended for children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal data, contact us at info@curewise.com. Upon notification, such data will be deleted.

Data Breach Notification

In the event of a data breach affecting your personal information, we will notify you and relevant authorities as required by applicable law.

Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources. We are not responsible for the privacy practices or content of third parties. We encourage you to review the privacy policies of any third-party sites you visit.

User-Generated Content

Health information and other content you submit to the Service is used only as described in this Policy and is not made publicly visible. Please do not share another person's health information without their consent and any required legal authority. We may moderate, remove, or restrict access to content that violates our TOS or applicable law.

Professional/Medical Disclaimer

Content on CureWise is for informational and educational purposes only and is not intended as medical advice, diagnosis, or treatment. CureWise is not a medical provider and does not practice medicine, provide clinical care, prescribe medications, order tests, perform procedures, or direct treatment. Your use of CureWise does not create a physician-patient, nurse-patient, fiduciary, or other professional relationship between you and CureWise or any clinician referenced through the Service. Always consult a qualified healthcare provider before making any medical decision. Never disregard professional medical advice or delay seeking it because of something you have read or received through the Service. In a medical emergency, call 911 or your local emergency services immediately. CureWise's AI-generated outputs may be incomplete, inaccurate, outdated, or not applicable to your specific circumstances. Always confirm important information with your healthcare provider. CureWise does not endorse or guarantee the accuracy of any content provided through the Service. See the TOS for further detail.

Data Subject Requests and Authorized Agents

You may designate an authorized agent to make privacy requests on your behalf, subject to verification. We will respond to requests within the timeframes required by law.

Do Not Track

Some browsers offer a "Do Not Track" feature. We do not currently respond to Do Not Track signals, but you may manage your cookie preferences as described above.

CureWise does not sell or share your personal information as those terms are defined under California law. CureWise does not use sensitive health information for third-party advertising.

EEA/UK Residents (GDPR)

If you are located in the European Economic Area, the United Kingdom, or Switzerland:

  • CureWise, Inc. acts as a data controller with respect to your personal data.

  • You have the rights described in the "Your Rights" section above under Articles 12–23 of the GDPR.

TO THE FULLEST EXTENT PERMITTED BY LAW, CUREWISE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. IN NO EVENT AND UNDER NO CIRCUMSTANCE(S) SHALL CUREWISE, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (1) USE OF THE CONTENT AND/OR SERVICE; (2) ERRORS, MISTAKES, OMISSIONS, OR INACCURACIES OF CONTENT; (3) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER RESULTING FROM YOUR ACCESS TO AND USE OF CUREWISE OR SERVICE OR CONTENT; (4) ANY ACCESS, AUTHORIZED OR NOT, OR USE OF THE SERVICE OR CONTENT OR OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN; (5) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE/CONTENT; (6) ANY BUGS, VIRUSES, TROJAN HORSES, MALWARE, OR DAMAGING SOFTWARE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE OR CONTENT; OR (7) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, E-MAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE BY THE SERVICE WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT CUREWISE IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING THE FOREGOING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, CUREWISE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO CUREWISE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

YOU SPECIFICALLY ACKNOWLEDGE THAT CUREWISE SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH AND UPON YOU.

The Service is controlled and offered by CureWise from its facilities in the United States of America. CureWise offers no representations that the Service is appropriate or available for use in all locations. Those who access or use the Service from other jurisdictions do so by their own choice and are responsible for compliance with local law, as applicable.

Legal Disputes, Agreement

You agree that: (1) the Service is based in California, United States of America; and (2) this Privacy Policy and any dispute arising from it shall be governed by the laws of the State of California and Federal laws, without choice-of-law principles applied. DISPUTE RESOLUTION BY BINDING ARBITRATION: EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY OR THE SERVICE SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT. THE ARBITRATION SHALL TAKE PLACE IN RIVERSIDE COUNTY, CALIFORNIA, OR AT SUCH OTHER LOCATION AS MUTUALLY AGREED. THE ARBITRATOR'S DECISION SHALL BE FINAL AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION. YOU AND CUREWISE EACH WAIVE ANY RIGHT TO A JURY TRIAL. This Privacy Policy and all integrated references constitute the entire agreement between you and CureWise concerning the Service. If any provision is deemed invalid by a court of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any term by CureWise shall be deemed a further or continuing waiver of such term or any other term, and CureWise's failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision now or in the future.

CureWise reserves the right to amend these terms to address updated policies at any time and without notice, and it is your responsibility to review these terms on an ongoing basis as you share or access content and otherwise access the Service. Your use of the Service or sharing or accessing any content following any amendment of these terms or updated policies will signify your assent to and acceptance of those revised terms.

YOU AND CUREWISE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE OR RELATED TO CONTENT MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED, EXPIRED, AND PROHIBITED.

By using the Service or in any way accessing or connecting with the Service, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy.
